About This Course

The "Aging and the Law: Families and Contracts" course delves into the complex legal issues that arise in later life concerning family dynamics and contractual agreements. This crucial program provides professionals with a clear, practical understanding of how relationships and financial arrangements among older clients can lead to significant legal complications.

You will gain expertise in:

  • Private Care Arrangements: Examining agreements where care is exchanged for property or financial assets, understanding their informal nature, potential pitfalls, and best practices for formal documentation.
  • Later Life Relationships: Exploring the legal implications of later life marriages, blended families, and common-law relationships on wills, inheritance, and advanced planning, including considerations for capacity to marry and separate.
  • Hidden Financial Arrangements: Investigating intergenerational loans, guarantees, and legacies within families, highlighting the motivations, risks of non-repayment, and potential for misunderstandings or abuse.
  • Grandparenting Issues: Addressing the rights and responsibilities of grandparents regarding access to grandchildren, financial support, and their role in substitute decision-making.

By the end of this course, you will be better equipped to identify legal risks, ask critical "what if" questions, and guide your clients toward decisions that thoughtfully balance personal relationships with legal responsibilities.
