About This Course

An overview of ABILs and Stop Loss Rules, which are relevant during these recessionary times.
A detailed analysis of the ABIL rules with particular emphasis on audit defense. An examination of various corporate and personal stop loss rules which can yield unexpected surprises.

You’ll learn how to:

  • Understand the definition and criteria for ABILs, including the interaction of Sections 39(1)(c) and 50(1) of the Income Tax Act.
  • Identify the importance of "small business corporation" status and the "active business" test, especially in distressed business scenarios.
  • Prepare for anticipated CRA audits on ABIL claims by knowing the essential documentation requirements for both share and debt investments.
  • Grasp the intent behind stop loss rules as mechanisms to prevent artificial loss creation among affiliated parties.
  • Distinguish between different types of stop loss rules applicable to depreciable and non-depreciable capital property, as well as superficial losses.
  • Master the definition of "affiliated persons" and its narrow application compared to "related" or "associated" parties.
  • Analyze loss restriction events (LREs) and their impact on net capital losses, non-capital losses, and other tax attributes following an acquisition of control.
  • Apply the "same or similar business" test crucial for determining the usability of non-capital losses post-LRE.
  • Strategically manage trust structures to avoid unintended loss restriction events, particularly concerning changes in trustees and corporate control.
